Common questions

Will the city make me tear out my unpermitted ADU?

Rarely, and the law points the other way. Los Angeles offers an amnesty path for units built before 2018, and state law limits enforcement against older units that can be brought to a relaxed standard. Demolition orders are for units that cannot be made safe.

Will I get fined for coming forward?

Coming forward voluntarily costs permit fees, not punitive fines. Waiting for a code enforcement complaint adds citation fees, deadlines and an inspector who did not choose to be there. Voluntary is cheaper in every case we have seen.

Does the unit have to meet today's code?

Not entirely. The amnesty path applies the code in effect when the unit was built for many items, with life-safety items such as egress, smoke detection and electrical safety brought current. That is the difference that makes legalization affordable.

How long does legalization take?

Typically 4 to 7 months: assessment and drawings in the first month, plan check in months two to four, corrections and inspections after that. Faster than a new build because the structure exists.

Can I legalize before selling the house?

Yes, and it is usually worth it. A legalized unit adds legal square footage and rentable value to the sale. Starting legalization after a buyer's inspector finds the unit means negotiating from the weakest position available.
